Estranged Husband In Missing Mom Case Wants Court To Stop Divorce Proceedings

Lawyers representing Fotis Dulos, the estranged husband of the New Canaan missing mother of five, Jennifer Farber Dulos, filed a motion asking a judge to stop divorce proceedings as long as his wife is missing.

"Obviously, Fotis wants to see his children.," said attorney Norm Pattis after the motion was filed Friday afternoon, June 26. "We will address that in due course. 

"In the meantime, we do not see how the divorce action can fairly and equitably proceed in her absence. Her counsel continues to chest thump in the apparent absence of a client. We are asking the court to stop the wasteful charade.”  

In the motion, Pattis says that it's impossible for Jennifer Dulos' attorney, Reuben Miller, to proceed without his client. 

“To permit Attorney Midler to proceed on that motion (or any motion) that he undoubtedly did not discuss with his client (as it was filed after she was reported missing) and who currently does not intend to bring to any hearing given her status is not a tenable position for the court to sustain,” the motion said.

Jennifer Dulos has been missing since Friday, May 24. Since that time, a massive search has been underway by the New Canaan Police Department, with the assistance of the Connecticut State Police and numerous other agencies. 

The two were embroiled in an intensely contentious divorce when Jennifer Dulos disappeared. 

Since her disappearance, her mother, Gloria Farber, who is watching over the Dulos' five children in Manhattan, has filed for emergency legal custody of the children.

In a motion filed in court, Farbe's attorney, Anne Draginis, stated that "it would be detrimental to the children" to see their father in the midst of her disappearance.

On Wednesday, June 26, Judge Donna Heller said she hopes to issue a decision soon on the mother's motion.
